Terms and Conditions of designfrom.be

These Terms and Conditions apply to every product offered on the designfrom.be webshop and all deliveries. Every order implies acceptance of these terms of sale. Belgian law exclusively applies to these Terms and Conditions.

Purchase and payment

• The agreement between designfrom.be and you as the buyer is established once you have accepted the conditions set. The absence of a signature does not detract from the binding force of the acceptance.
• designfrom.be reserves the right to refuse an order or to subject it to additional conditions, for example for large orders, orders by minors, incomplete order procedures or problems with previous orders.
• designfrom.be confirms every purchase by e-mail. Until a confirmation e-mail has been sent, the agreement is not in force. The buyer is responsible for ensuring the confirmation does not end up in the spam folder.
• Payment is made exclusively in advance via the offered payment methods.
• designfrom.be retains ownership of all goods until full payment has been received.
• Payment transactions are securely processed via PAY, certified payment platform, with SSL encryption.
• In case of late payment, designfrom.be is entitled to terminate the agreement with immediate effect or to suspend delivery.

Delivery and delivery times

• Stated delivery times are approximate. The maximum delivery period is 30 days after receipt of the order (or after receipt of payment for bank transfers).
• Temporarily out-of-stock products are indicated with the expected availability date.
• Once the products are delivered to the specified delivery address, the risk transfers to the buyer.
• designfrom.be delivers exclusively within the European Union: Belgium, Netherlands, Luxembourg, France, Germany. For other EU countries, please contact us.
• Delivery in Belgium is via bPost. Exceptions may apply based on weight or delivery address.
• Delivery and shipping costs are communicated before confirming the purchase.

Product information

• Information, images and data relating to products are presented as accurately as possible. designfrom.be is not liable for printing errors or technical data provided by suppliers.
• Out-of-stock products may appear on the website without a purchase button. In case of inability to deliver, you will be notified as soon as possible.
• All products offered comply with legal standards and may be sold online.

Cooling-off period and returns

• You have a legal cooling-off period of 14 calendar days from the day after receipt of the product.
• During the cooling-off period, you must handle the goods and packaging with care. There is no right of withdrawal if the product and packaging are no longer in original, complete, undamaged and unused condition.
• Goods must be returned undamaged, unused and unopened within 14 calendar days of receipt. All documentation and packaging materials must be included.
• The direct return costs are at the buyer''s expense (fixed price €4.55). Unfranked shipments are refused.
• designfrom.be will refund the full purchase amount including initial shipping costs within 14 days of receiving the returned goods in conformity with the conditions.
• Exceptions: custom-made or personalised products, perishable goods, CDs/DVDs/software with broken seal.

Warranty

• designfrom.be follows the official warranty guidelines of its suppliers. These vary by brand and are always stated at the time of purchase.
• Warranty handling is at designfrom.be''s expense, except for shipping costs incurred by the consumer.

Defects

• Inspect the goods immediately upon receipt. Were the correct goods delivered? Do they meet the agreed quality requirements?
• A visible defect must be reported within 7 working days of delivery.
• A non-visible defect must be reported in writing within 2 working days of discovery, and at the latest within 2 months of delivery, via contact@designfrom.be.
• Return costs for goods not conforming to the description are at designfrom.be''s expense — provided prior notification was given.

Force majeure

• Force majeure includes all external causes over which designfrom.be has no control and which prevent it from fulfilling its obligations.
• During force majeure, delivery and other obligations are suspended. If force majeure lasts more than 8 weeks, both parties are entitled to terminate the agreement without compensation.

Prices

• All prices are in euros and include VAT, Recupel, BEBAT and Reprobel. Shipping costs are stated separately.
• Offers are valid while stocks last and for the stated period.
• In the event of a price increase after the agreement is concluded, you may terminate the agreement regardless of the percentage of increase.

Intellectual property rights

The content of this site — brands, logos, designs, texts, images, etc. — is protected by intellectual property rights and belongs to designfrom.be or third-party rights holders.

Questions and complaints

• Complaints about visible defects must be reported within 7 days of delivery. In the event of a valid complaint, our liability is limited to the exchange of goods or refund of the amount paid.
• designfrom.be handles questions and complaints within a reasonable timeframe.

Disputes

• Belgian law exclusively applies to all offers and agreements.
• All disputes are submitted to the competent court in Kortrijk, unless a mandatory legal provision designates another court.

Limitation of liability

designfrom.be cannot be held liable for damage resulting from the use of purchased goods or the website, including indirect damage, unless caused by intent or gross negligence on the part of designfrom.be.
